These terms (the “Terms”) apply to your use of the Site and to any order you place with us through it. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
Please read these Terms carefully and keep a copy for your records. They should be read together with our Returns & Refund Policy, our Shipping Policy and our Privacy Policy, all available on the Site.
2. Using the Site
You must be at least 18 years old to place an order. The Site is intended for personal, non-commercial use. If you buy on behalf of a business, some of the rights in these Terms that protect consumers will not apply to you.
The information on the Site is not intended for use in any country where that use would be contrary to law. If you access the Site from outside the United Kingdom, you are responsible for complying with your local laws.
3. Intellectual property
We own or are licensed to use all intellectual property rights in the Site, including its text, photographs, graphics, logos, product names, designs, source code and other content (the “Content”). These rights are protected by copyright, trade mark and other laws in the United Kingdom and around the world. All rights are reserved.
We grant you a limited, non-exclusive, non-transferable, revocable licence to view the Site and to download or print copies of the Content for your own personal, non-commercial use. You must not copy, reproduce, republish, distribute, sell, adapt or otherwise exploit any Content for commercial purposes without our written permission. To ask for permission, email support@codenatura.shop.
If you breach this section, your right to use the Site ends immediately.
4. Your feedback and reviews
If you send us feedback, suggestions or ideas about the Site, you agree that we may use them to improve our business without paying you or crediting you.
If the Site lets you post reviews or other content (“Contributions”), you remain the owner of what you post. By posting it, you give us a free, non-exclusive, worldwide licence to use, display, reproduce and publish your Contribution on the Site and in our marketing, for as long as we choose to use it.
You confirm that your Contributions are your own, are based on your genuine experience, and do not infringe anyone else’s rights. Reviews must not contain offensive, abusive, discriminatory, defamatory or unlawful content, or false or misleading statements, and must not be posted by competitors or as part of an organised campaign. We may remove any Contribution at any time if we reasonably believe it breaks these Terms. We do not endorse reviews and are not responsible for them.
5. What you must not do
You must use the Site only for lawful purposes. You must not:
- use the Site in a way that breaks any law or regulation, or that is fraudulent or misleading;
- copy or scrape the Site, or use bots, spiders or other automated tools to collect data from it, other than ordinary search engine use;
- attempt to gain unauthorised access to the Site, our systems or other users’ accounts, or interfere with or disrupt the Site or its security;
- upload or transmit viruses or other harmful code;
- reverse engineer, decompile or copy the Site’s software;
- impersonate another person, or provide false or misleading information;
- harass, abuse or threaten our staff, agents or other users;
- use the Site to buy products for resale unless we have agreed to this in writing, or use a buying agent to place orders; or
- use the Site to compete with us.
If you breach this section, we may suspend or end your access to the Site, cancel your account and, where appropriate, report you to the authorities.
6. Our products
We try to display our products, including colours, descriptions and images, as accurately as possible. Colours may vary slightly depending on your screen, and packaging may change from time to time.
Our products are food supplements. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease. Food supplements are not a substitute for a varied, balanced diet and a healthy lifestyle. Please read the label and follow the recommended daily intake. Do not exceed the recommended daily intake. Keep out of the reach of young children. Our products are not suitable for children or for pregnant or breastfeeding women. If you have a medical condition or take any medication, speak to your doctor before use.
All products are subject to availability. We may discontinue products at any time.
7. Placing an order and forming a contract
When you place an order on the Site, you are making an offer to buy. We will email you to confirm that we have received your order. This is not an acceptance of your order. A contract between us is formed only when we send you a dispatch confirmation email, or when we begin to process your order for delivery, whichever happens first.
If we cannot accept your order (for example, because a product is out of stock, because of an error in the price or product description, or because we cannot deliver to your address), we will tell you as soon as possible and refund any payment you have made.
You agree to provide accurate, current and complete information when you order, and to keep it up to date.
We may refuse or limit orders that appear to be placed by dealers, resellers or distributors, or that we reasonably suspect to be fraudulent.
8. Prices and payment
Prices are shown in pounds sterling (£) and include VAT where it applies. Delivery charges, if any, are shown at checkout before you confirm your order.
We may change our prices at any time, but changes will not affect an order that has already been confirmed. We check prices carefully, but errors can happen. If we discover an error in the price of a product you have ordered, we will tell you as soon as possible and give you the choice of continuing your order at the correct price or cancelling it for a full refund. We will not be bound to supply a product at an incorrectly displayed price if the error was obvious and unmistakable and could reasonably have been recognised by you as a mispricing.
You can pay using the payment methods shown at checkout. Payment is taken when you place your order. Payments are handled securely by our payment providers, and we do not store your full card details.
9. Delivery
We deliver to the destinations shown at checkout. Our estimated delivery times and charges are set out in our Shipping Policy. These are estimates, not guarantees.
Unless we tell you otherwise, we will deliver your order within 30 days of the date we confirm it. If we fail to deliver within that time, you may cancel your order and we will refund you in full.
The products are your responsibility from the time they are delivered to you. Ownership passes to you when we have received full payment.
If no one is available to receive your delivery, the carrier will leave a note explaining how to rearrange delivery or collect your order.
10. Your right to cancel, returns and refunds
If you are a consumer, you have a legal right to cancel your order within 14 days of receiving your goods, without giving a reason. The full details of how to cancel, how to return products and how we process refunds are in our Returns & Refund Policy, which forms part of these Terms.
Please note that, for health protection and hygiene reasons, you cannot cancel or return sealed products once you have opened them (unless they are faulty).
11. Faulty or incorrect products
We are required by law to supply products that are of satisfactory quality, fit for their purpose and as described. If a product you buy from us is faulty, damaged or not as described, you have legal rights, including the right to a refund, repair or replacement under the Consumer Rights Act 2015. Please contact us at support@codenatura.shop as soon as possible, with your order number and a photograph, and we will tell you what to do next.
Nothing in these Terms affects your legal rights as a consumer.
12. Privacy
We care about your privacy. Our Privacy Policy explains how we collect and use your personal data. By using the Site, you acknowledge that you have read it.
13. Links and third-party content
The Site may contain links to websites run by other people. We do not control these sites and are not responsible for their content, privacy practices or security. A link does not mean that we endorse the site or its owner.
14. Availability of the Site
We try to keep the Site available, but we cannot guarantee that it will always be uninterrupted or error free. We may suspend, withdraw or change all or part of the Site, for example for maintenance. We will not be liable to you if the Site is unavailable at any time.
We try to keep the information on the Site accurate, but it may contain typographical errors, inaccuracies or omissions, including in descriptions, prices and availability. We may correct these at any time.
15. Our responsibility to you
Nothing in these Terms limits or excludes our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- any breach of your legal rights as a consumer, including your rights under the Consumer Rights Act 2015; or
- anything else that cannot be limited or excluded by law.
Subject to that, if we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into the contract.
We are not responsible for any loss or damage that was not foreseeable. We supply products for domestic and private use only. We are not liable to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
We are not responsible for any loss or damage that results from your misuse of a product, or from not following the usage instructions and warnings on the label.
16. Events outside our control
We are not liable for any delay or failure to carry out our obligations under these Terms if it is caused by an event outside our reasonable control, such as severe weather, strikes, fire, flood, war, terrorism, epidemic, failure of utilities or transport networks, or acts of government. If this happens, we will contact you as soon as possible, and we will resume our obligations as soon as we reasonably can. If the delay continues for a significant period, you may cancel your order and we will refund you for any products not delivered.
17. Suspending or ending your access
We may suspend or end your access to the Site, or cancel an order that we have not yet dispatched, if you break these Terms, if we reasonably suspect fraud, or if we are required to by law. If we cancel an order for these reasons, we will refund any payment you made for the part of the order that we have not dispatched.
If we suspend or terminate your account, you must not create a new account in your own name, a false name or the name of anyone else.
18. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes in the law or in how we run the Site. The version that applies to your order is the one in force when you placed it. We will update the “Last updated” date at the top of this page when we make changes, and your continued use of the Site after that date means you accept the updated Terms.
19. Complaints
We want you to be happy with your experience. If you have a complaint, please contact us at support@codenatura.shop, or write to us at the address above, and we will do our best to resolve it quickly.
If we cannot resolve your complaint, you can get free, impartial advice from the Citizens Advice consumer service at citizensadvice.org.uk or on 0808 223 1133.
20. Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes), are governed by the law of England and Wales.
If you are a consumer, you can bring proceedings in the courts of the part of the United Kingdom where you live (England and Wales, Scotland or Northern Ireland). If you live in another country, you may also have the right to rely on the mandatory consumer protection laws of that country. If you are a business, the courts of England and Wales have exclusive jurisdiction.
21. General
- Entire agreement: These Terms, together with the policies they refer to, are the entire agreement between you and us about your use of the Site and your orders.
- Waiver: If we do not enforce a right under these Terms straight away, that does not mean we have given it up.
- Severability: If any part of these Terms is found to be unlawful or unenforceable, the rest remains in force.
- Assignment: We may transfer our rights and obligations under these Terms to another organisation, and we will tell you if we do. You may not transfer your rights or obligations to anyone else without our written permission.
- Third parties: Only you and we have rights under these Terms. No one else can enforce them under the Contracts (Rights of Third Parties) Act 1999.
- Electronic communications: You agree that we may contact you and give you notices by email or through the Site, and that this satisfies any legal requirement for communications to be in writing.
